THIS DECLARATION OF COVENANTS, CONDITIONS AND RESTRICTIONS (this "Declaration") is made this 24th day of January, 1996, by TRIWEST ENTERPRISES, INC., a Texas Corporation (hereinafter referred to as "Declarant").
W I T N E S S E T H:WHEREAS, Declarant is the owner of that certain real property referred to in Article II and described on Exhibit "A" of this Declaration, which property represents a residential community development known as "Rancho Serena."Declarant desires to provide for the preservation of values and amenities of such real property.
NOW, THEREFORE, Declarant hereby declares that the real property referred to in Article II and described on Exhibit "A," and such additions thereto as may hereafter be made pursuant to Article II hereof, is and shall be held, transferred, sold, conveyed and occupied subject to the covenants, conditions, restrictions, easements, charges and liens (sometimes collectively referred to herein as "Covenants and Restrictions") hereinafter set forth.

All homeowners are responsible for consulting the Covenants, Conditions and Restrictions prior to making any decisions that may be affected by that document.
